The Chicago Computer Law attorneys of Cheely, O’Flaherty & Ayres know that the law is always changing. There is no area in which this is more apparent than the field of Computer Law. As new technologies and ways of doing business over the Internet constantly develop, the odds of legal conflict increase significantly. Several recent developments in Internet Law and E-Commerce that may affect you or your company are:
- In 2006, the United States Supreme Court upheld a law stating a patent can be infringed when certain aspects of the product are used in the United States, and other aspects are used outside the country. The device in question in this case was the Blackberry PDA.
- In 2005, a United States Court of Appeals held that a patent against the website Amazon.com for their “1-Click” ordering system was invalid. Amazon.com is still able to employ the “1-Click” method of ordering for the convenience of their customers.
- In 2005, a United States Court of Appeals held that downloading copyrighted music through a file-sharing network is considered direct infringement and not fair use. Such internet downloads continue to be illegal.
In 2006, a United States District Court held that a company temporarily copying web pages is considered fair use under the Digital Millennium Copyright Act, provided the website operator was aware of and chose not to stop such copying. Google, Inc. continues to temporarily copy pages as part of its archiving process.
